Regulatory Filings for Hedge Funds
Hedge Fund regulation by the SEC is anticipated to be passed before December 31, 2009, and it's expected to look much like the regulation currently placed on Investment Advisers in SEC Rule 206 that requires all Investment Advisors to have a compliance program, chief compliance officer, and annual review of their compliance program. To meet these specifications, firms must complete and file documentation as proof of their compliance program, registration of their firm and Chief Compliance Officer, and paperwork as proof of their annual review. ACI currently works with Broker Dealers and Investment Advisors to fill out and file all paperwork currently required by the SEC and is prepared to do the same for Hedge Funds upon the arrival of new legislation. We advise hedge funds to enter into this process sooner, rather than later, in order to be in compliance before the legislation passes so that they can smoothly continue moving forward with their business practices with SEC approval.
